Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you", "user") and vitalpulse.org ("VitalPulse", "we", "us", "our"), governing your access to and use of the VitalPulse website at vitalpulse.org, any associated mobile applications, and all related content, features, and services (collectively, the "Service").

By accessing or using the Service in any way — including browsing articles, using interactive tools, creating an account, or subscribing to our newsletter — you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

4.2 Account Responsibility

You are solely responsible for all activity that occurs under your account. VitalPulse is not liable for any loss or damage arising from your failure to maintain the security of your account credentials. We may refuse registration, cancel accounts, or remove usernames at our sole discretion.

4.3 One Account Per Person

You may create only one account per person. Creating multiple accounts to circumvent bans, restrictions, or to manipulate any feature of the Service is prohibited and may result in permanent termination of all associated accounts.

4.4 Account Deletion

You may delete your account at any time through your account settings or by emailing privacy@vitalpulse.org. Upon deletion, your personal data will be processed in accordance with our Privacy Policy. Certain data may be retained as required by law.

The Service is provided for personal, non-commercial use only unless you have entered into a separate written agreement with us for commercial use. The following sets out what is and is not permitted.

5.1 Acceptable Use Standards

You agree not to use the Service in any way that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable. Any violation of these standards may result in immediate termination of your access.

VitalPulse is an editorial health and wellness publisher. Our content is produced by writers, editors, and contributors who may or may not be registered healthcare professionals. Even where content is authored or reviewed by a qualified professional, it is intended as general information and does not create a doctor-patient or therapist-client relationship between you and VitalPulse or any of our contributors.

6.1 Specific Limitations

• Nutritional information is general guidance only — it does not account for your individual health conditions, allergies, medications, or nutritional needs
• Exercise content may not be appropriate for all fitness levels or health conditions — consult a doctor before starting any new exercise programme, particularly if you have a pre-existing condition
• Mental health content, including tools like mood trackers, journaling prompts, and breathing exercises, is for wellbeing support only and does not replace professional psychiatric or psychological care
• Quiz results and self-assessment scores are indicative only — they are not clinical assessments or diagnoses
• Supplement and medication information is general only — always consult a pharmacist or doctor before taking any supplement or changing medication

6.2 Reliance on Information

Any reliance you place on information published on VitalPulse is strictly at your own risk. To the fullest extent permitted by law, we exclude all liability for actions taken or not taken based on the content of our Service.

All content on the Service — including but not limited to text, articles, guides, images, graphics, logos, icons, audio, video, interactive tools, software, and the overall design and compilation of the Service ("Content") — is owned by or licensed to vitalpulse.org and is protected by copyright, trade mark, database rights, and other intellectual property laws.

7.1 Ownership

The VitalPulse name, logo, and all associated marks are trade marks of vitalpulse.org. All other trade marks, product names, and company names mentioned on the Service are the property of their respective owners. Nothing in these Terms grants you any right to use our trade marks without our prior written consent.

7.2 Licence to You

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service and its Content for your personal, non-commercial purposes only. This licence does not include any right to:

• Reproduce, distribute, or publicly display our Content beyond personal use
• Create derivative works based on our Content
• Use data mining, robots, scraping, or similar data-gathering tools
• Download or copy account information for the benefit of another party

7.3 DMCA / Copyright Infringement

8.1 Content You Submit

If you submit any content to the Service — including comments, feedback, suggestions, or any other materials ("User Content") — you grant VitalPulse a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display that User Content in connection with operating and improving the Service.

8.2 Your Warranties

By submitting User Content, you represent and warrant that:

• You own the User Content or have the right to grant the licence above
• The User Content does not infringe any third party's intellectual property rights, privacy rights, or any other rights
• The User Content is not defamatory, obscene, harmful, threatening, or otherwise objectionable
• The User Content does not contain any viruses, malware, or other harmful code

8.3 Private Data (Journals, Trackers)

Content you enter into personal tools — such as journal entries, mood logs, and habit tracker data — is stored locally in your browser by default and is not submitted to our servers unless you opt into cloud sync. See our Privacy Policy for full details. We do not claim any ownership over this personal data.

8.4 Monitoring and Removal

We reserve the right (but are under no obligation) to review, monitor, edit, or remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. We are not responsible for any User Content posted by users.

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by VitalPulse. These links are provided for your convenience only.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not warrant or endorse any third-party products, services, or websites.

The Service may integrate third-party tools including Google Analytics, Google AdSense, Mailchimp, and others. Your use of these integrated services is also subject to those providers' terms and privacy policies. Links to their policies are available in our Privacy Policy.

The Service displays third-party advertisements served by Google AdSense and, in some cases, direct advertisers. By using the Service, you acknowledge and agree that:

12.1 Cap on Liability

To the maximum extent permitted by law, VitalPulse's total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total amount paid by you to VitalPulse in the 12 months preceding the claim.

12.2 Essential Basis

You acknowledge that VitalPulse has set the terms of the Service, including this limitation of liability, in reliance upon the limitations and exclusions set out in this Section, and that these form an essential basis of the bargain between us. The limitations apply even if VitalPulse has been advised of the possibility of such damages.

You agree to defend, indemnify, and hold harmless vitalpulse.org and its directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service, including content you access or rely on
• Any User Content you submit to the Service
• Your violation of any third party's rights, including intellectual property or privacy rights
• Any claim that your User Content caused damage to a third party

This indemnification obligation will survive termination of these Terms and your use of the Service. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with our defence of such claims.

14.1 Termination by VitalPulse

We may suspend or terminate your access to the Service, with or without notice, at our sole discretion, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service immediately ceases.

14.2 Termination by You

You may stop using the Service at any time. If you have an account, you may request deletion through your account settings or by contacting privacy@vitalpulse.org.

14.3 Effect of Termination

Upon termination, all licences granted to you under these Terms will immediately cease. The following Sections will survive termination: Section 6 (Medical Disclaimer), Section 7 (Our Content & IP), Section 11 (Disclaimers), Section 12 (Limitation of Liability), Section 13 (Indemnification), Section 15 (Governing Law), and any other provisions that by their nature should survive.

14.4 Data After Termination

Following account deletion, we will handle your personal data in accordance with our Privacy Policy. Content stored locally in your browser (journal entries, habit data) will remain on your device until you clear your browser data.

15.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws without regard to conflict of law principles.

15.4 Informal Resolution First

Before initiating any formal legal proceedings, we encourage you to contact us at legal@vitalpulse.org to seek an informal resolution. We will make a genuine effort to resolve your concern within 30 days.

15.5 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. This does not affect your statutory consumer rights.

We reserve the right to modify these Terms at any time. When we make material changes, we will:

1. Update the "Last updated" date at the top of this page
2. Display a prominent notice on the Service for at least 30 days
3. Email registered users directly if the changes are material and affect existing rights
4. Archive prior versions so they remain accessible on request

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service and may request account deletion.
